What does “Power of Attorney” Mean?

According to California law, Power Of Attorney refers to the authority that is granted by one individual (referred to as the “Principal”) to another individual, (referred to as the attorney-in-fact) to act on their behalf. This type of power granting is useful in an instance where the principal is unable to manage his or her own affairs due to incapacitation or that they are unavailable.

In California, Power of Attorney is established in order to allow another person to act on the behalf of an individual if they were to become incapacitated. This power is temporarily granted in certain circumstances or if the individual is deemed incompetent, and cannot manage their own affairs. This status cannot be granted for any reason if the individual remains competent and available.

The purpose of having an individual listed, as Power of Attorney is to assure that someone is able to act in your best interest if you are unable to make decisions for your self. This is most often implemented in matters of health care where a person cannot vocalize what they would like to happen to them.

It is important to know that in The United States nobody has the legal authority to speak on the behalf of an unconscious or incompetent individual without Power of Attorney status, not even your spouse. A legally binding Power of Attorney document makes for certain that the individual whom you appoint is the only one who is able to make decisions for you. When you have a Power of Attorney plan in place, the appointed individual can also manage and maintain all of your assets and finances while you are incapacitated assuring financial security and maintenance.
